The protection of natural persons in relation to the processing of personal data is a fundamental right protected by article 18.4 of the Spanish Constitution.
The Internet has become an omnipresent reality in both personal and professional life. Much of our activity takes place online and is of fundamental importance both for human communication and for the development of society. Already in the nineties, aware of the impact that the Internet was going to have, the pioneers of the Internet proposed drafting a Declaration of the Rights of Citizen on the Internet.
Today the risks and opportunities that the world of networks offers are quite clearly identified. It is up to the public powers to promote policies that make citizens' rights effective on the Internet, promoting the equality of citizens and the groups in which they belong to make possible the full exercise of fundamental rights in the digital reality. The digital transformation of our society is already a reality in our present and future development, both socially and economically.
In this context, Regulation 2016/679 of the European Parliament of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and the free circulation of these data (General Data Protection Regulation, RGPD) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPDyGDD) constitute the legal basis for the protection of natural persons in relation to the processing of their personal data.
